James Vivenzio sued Penn State Monday for negligence, saying he told university officials about the private Facebook pages depicting hazings and alleged sexual assault eight months before he went to the police. The Kappa Delta Rho fraternity lost recognition for three years after an investigation into two private Facebook pages with photos of nude women — many of them unconscious — were discovered. He was arrested Thursday. The move comes as police investigate allegations that members of Kappa Delta Rho posted photos of nude women to a private, invitation-only Facebook page. Students in fraternities and sororities at Penn State were asked to avoid reporters' questions in light of Kappa Delta Rho's suspension for posting naked photos of mostly unconscious women on Facebook. Police initially said any Kappa Delta Rho fraternity brother or alumnus responsible for posting photos of naked women on a secret Facebook page could face misdemeanor charges. But legal experts told BuzzFeed News that if victims come forward, the charges could be elevated to felonies.
